Change in scope of work for Mandlaglo Commodities (Pty) Ltd project (reference: 23-2488-AUTH)

The Mandlaglo Commodities (Pty) Ltd project (reference: 23-2488-AUTH) initially commenced and was submitted under a Basic Assessment process for the ceding of Portions 2, 4, 5, and 8 of the farm Weltevreden 193 IS; Portions 3, 5, and 6 of the farm Uitgezocht 194 IS; and Portions 3, 12, 14, 21, 22, and 23 of the farm Kafferstad 195 IS, so that they are included into Overlooked Colliery Alpha (Pty) Ltd’s Mining Right, located in the Magisterial District of Bethal, Mpumalanga. Additionally, Mandlaglo intend to develop a wash plant on Portion 1 of the farm Kafferstad 195 IS. A Public Participation Process was conducted as part of the Basic Assessment process. However, following further consultation with the Department of Mineral Resources and Energy (DMRE) and a change in the listed activities, the project has now progressed to a Scoping and Environmental Impact Assessment process. A new Public Participation Process is being conducted. Please note that you will be notified of the Draft Environmental Impact Assessment, which you can provide comments on, in due course.

PROJECT:

You are notified of the proposed project at Izimbiwa Graspan Extension Colliery situated on portion 31 of the farm Elandspruit 291JS within the Steve Tshwete Local Municipality, Nkangala District Municipality. Izimbiwa intends to mine the Elandspruit pan within the existing MR of Graspan Extension Colliery, which was not included in the approved MWP. In order for Izimbiwa to mine the additional resources, a Section 102 Amendment is required to update the Environmental Authorisation and the EMPr to include the new resource section. A new Water Use Licence with an offset strategy will also be required before mining can take place.

To this effect, an integrated environmental application process will be followed by means of the S&EIR Process. The Draft Environmental Impact Assessment Report (DEIAR) will be made available for a 30-day public review period (06 November 2024 to 06 December 2024) on the website (http://ecoelementum.co.za/downloads/) and per download link (upon request). Dear Stakeholder

Notice is issued in terms of Sections 40 and 41(4) of the National Water Act, Act 36 of 1998 (NWA) and the requirements of Government Notice R267 published in Government Gazette 40713 dated 24 March 2017 (Procedural Requirements for the Water Use Licence Application and Appeals).

The Seriti Power (Pty) Ltd,(Seriti) New Largo Colliery is located approximately 4.5 km south east of Ogies, in the eMalahleni Local Municipality, in the Mpumalanga Province. The mine is operational and has three Water Use Licences (WULs) authorised to undertake activities that are described as water uses under Section 21 of the National Water Act, 1998 (Act No. 36 of 1998), namely:

WUL: 04/B20G/ACFGIJ/2538, File: 16/2/7/B200/C528 dated 31 March 2023, which supersedes the WUL dated 11 January 2015 as amended on 25 October 2019;
WUL: 04/B20G/CI/2246, File: 16/2/7/B200/C528 dated 22 August 2014; and
WUL: 04/B20F/ACFGI/2310, File: 16/2/7/B200/K524 dated 22 September 2013.

Although these water use authorisations are in place, additional water uses associated with the mining of Pit A (Honingkrantz Block specifically) have been identified that require authorisation, as a result of revisions to the mine plan. These water uses include mining of wetlands; location and operation of the New Largo Coal mining operations, pipelines, powerlines, haul roads and associated mine infrastructure in the regulated area of a watercourses; dust suppression; and dewatering in the Honingkrantz Block.

New Largo is applying for a water use licence application (WULA) from the Department of Water and Sanitation, in terms of Section 41 of the National Water Act, 1998 (Act No. 36 of 1998) (NWA) for water uses as defined in Section 21 of the NWA. GN R.267 stipulates that a WULA must be supported by an Integrated Water and Waste Management Plan (IWWMP) and a range of technical studies such as wetland and other environmental related specialist studies.

The following water uses form part of the WULA:

Section 21(c): Impeding or diverting the flow of water in a watercourse;
Section 21(g): Disposing of waste in a manner which may detrimentally impact on a water resource;
Section 21(i): Altering the beds, banks, course or characteristics of a watercourse; and
Section 21 (j): Removing, discharging or disposing of water found underground if it is necessary for the efficient continuation of an activity or for the safety of people.

WSP Group Africa (Pty) Ltd (WSP) has been appointed to undertake the WULA and public participation process in terms of the NWA.

PUBLIC COMMENT INVITED ON THE WATER USE AUTHORISATION PROCESS

Stakeholders are invited to register as Interested and Affected Parties and provide written comments regarding the proposed water use authorisation process by 01 October 2024. The 60-day comment period starts on 02 August 2024 and will conclude on 01 October 2024.

FOR THE PROPOSED RASTABAN SOLAR PARK AND CONNECTION INFRASTRUCTURE ON PORTION 1 OF FARM NOOITGEDACHT 300 JS WITHIN THE EMALAHLENI LOCAL MUNICIPALITY, NKANGALA DISTRICT MUNICIPALITY, MPUMALANGA PROVINCE

Rastaban Energy (Pty) Ltd (2024/019029/07) is proposing a Solar Photovoltaic (PV Facility (Rastaban Solar Park) and associated infrastructure on the Portion 1 of Farm Nooitgedacht 300 JS (299 ha), located within the Emalahleni Local Municipality, Nkangala District Municipality, Mpumalanga Province.

The Rastaban Solar Park will consist of construction, operation and maintenance of a PV Powerplant with a maximum export capacity up to 120 MW with a footprint of 210 ha.

The Rastaban Solar Park will be connected to the Eskom “Vulcan” Distribution Substation, through a new 132kV powerline (double circuit) 2.15 km long transverse the following properties:

Portion 1 of Farm Nooitgedacht 300 JS,
Portion 6 of Farm Nooitgedacht 300 JS,
Portion 25 of Farm Nooitgedacht 300 JS,
Portion 121 of Farm Nooitgedacht 300 JS,
Portion 133 of Farm Nooitgedacht 300 JS, and
Portion 122 of Farm Nooitgedacht 300 JS (Eskom Vulcan Substation)

Environmental Authorisation Process:

The site is located within the Renewable Energy Development Zone 9 (GN 142, GG 44191 of 26 February 2021).

Exigent Engineering Consultants have been appointed by Rastaban Energy (Pty) Ltd as the Environmental Assessment Practitioner (EAP) to undertake the Basic Assessment Process (BA) and the Public Participation Process. Notice is given of the Environmental Authorization application to be submitted to the Department of Forestry, Fisheries and Environment (DFFE) in terms of the EIA Regulations published in Government Notice No. R982 of 4 December 2014, as amended, under Section 24(5), and 44 of the National Environmental Management Act (Act No. 107 of 1998), as amended (GNR326, 2017), of the intent to carry out the EIA Process (in terms of listed activities 11(i), 12(ii)(c), 19, 24(ii), 28(ii) and 30 of Listing Notice 1 – GN R327, listed activities 1 and 15 of Listing Notice 2 – GN R325 and listed activity 4(f)(i)(cc)(ee), 12(f)(i))(ii) and 14(ii)(c)(f)(dd)(ff) of Listing Notice 3 – GN R324). Activity 11: The development of facilities or infrastructure for the transmission and distribution of electricity-

(i) outside urban areas or industrial complexes with a capacity of more than 33 but less than 275 kilovolts.

Activity 12: The development of (ii) infrastructure or structures with a footprint of 100 square metres or more; where such development occurs (c) if no development setback exists, within 32 meters of a watercourse, measured from the edge of a watercourse; -excluding- (aa) the development of infrastructures within existing ports or harbours that will not increase the development footprint of the port or harbour; (bb) where such development activities are related to the development of a port or harbour, in which case activity 26 in Listing Notice 2 of 2014 applies; (cc) activities listed in activity 14 in Listing Notice 2 of 2014 or activity 14 in Listing Notice 3 of 2014, in which case that activity applies; (dd) where such development occurs an urban area; (ee) where such development occurs with existing roads, road reserves or railway line reserves; or (ff) the development of temporary infrastructure or structures where such infrastructure or structures will be removed 6 weeks of the commencement of development and where indigenous vegetation will not be cleared.

Activity 19: The infilling or depositing of any material of more than 10 cubic metres into, or the dredging, excavation, removal of moving of soil, sand, shells, shell grit; pebbles or rock of more than 10 cubic metres of a watercourse; but excluding where such infilling, depositing, dredging, excavation, removal or moving – (a) will occur behind a development setback; (b) is for maintenance purposes undertaken in accordance with a maintenance management plan; (c) falls within the ambit of activity 21 of this Notice, in which case that activity applies; (d) occurs within existing ports or harbours that will not increase the development footprint of the port or harbour; or (e) where such development is related to the development of a port or harbour, in which case activity 26 in Listing Notice 2 of 2014 applies.

Activity 1: The development of facilities or infrastructure for the generation of electricity from a renewable resource where the electricity output is 20 megawatts or more

Activity 15: The clearance of an area of 20 hectares or more of indigenous vegetation.

GN R324 – NEMA EIA Listing Notice 3 of 2014: as amended

Activity 4: The development of a road wider than 4 metres with a reserve less than 13.5 metres, (f) Mpumalanga, (i) Outside urban areas; (cc) Sensitive areas as identified in an environmental management framework as contemplated in chapter 5 of the Act and as adopted by the competent authority; (ee) Critical biodiversity areas as identified in systematic biodiversity plans adopted by the competent authority and in bioregional plans.

41104286 – NOTICE OF THE PROPOSED ISIBONELO WASTE TRANSFER FACILITY – BASIC ASSESSMENT AND WATER USE AUTHORISATION PROCESSES, GOVAN MBEKI LOCAL MUNICIPALITY, MPUMALANGA PROVINCE

Dear Stakeholder

The Govan Mbeki Local Municipality (GMLM) proposes to develop a regional waste transfer facility (WTF) at eMbalenhle in Mpumalanga. The project will be located on ERF. 26487/0 of eMbalenhle Ext 26, eMbalenhle. The proposed project area is approximately 12 670 m2 and is located on the northern edge of the town in an area that is characterised by mixed light industrial and residential areas. Access to the site is via Fomo Sibiya Drive. An estimated 260 m3 of general / domestic, building (small quantities) and garden waste will be handled and stored at the proposed facility per day. The WTF will receive general waste from mainly eMbalenhle, Charl Cilliers, Evander, Kinross (includes Thistle Grove and Ext 25), Trichardt and Secunda.

In addition, the facility will also receive and handle recyclable waste. However, the site will not accept any hazardous waste.

WSP Group Africa (Pty) Ltd (WSP) has been appointed as the EAP to manage the respective environmental related authorisation applications, and public participation processes. In terms of Sections 24 and 24D of the NEMA (No. 107 of 1998), as read with GNR 983, GNR 984 and GNR 985 (as amended), the proposed project triggers a Basic Assessment Process.

Parties wishing to formally register as interested and affected parties (I&APs) in order to receive more information and/ or raise their comment(s) on the proposed project are requested to forward their full contact details to the Public Participation Office and disclose their interest in the project. RE: ESKOM APPEAL PURSUANT AGAINST THE NATIONAL AIR QUALITY OFFICER’S (NAQO) DECISION ON THE APPLICATIONS FOR POSTPONEMENT, SUSPENSION OF THE COMPLIANCE TIMEFRAMES, AND/OR ALTERNATIVE LIMITS RELATING TO THE MINIMUM EMISSION STANDARDS (MES) FOR ESKOM’S FLEET OF COAL AND FUEL-FIRED POWER STATIONS

Dear Stakeholder,

Eskom Holdings (Pty) Ltd applied for postponement, suspension of the compliance times frames, and or alternative limits relating to the National Environmental Management: Air Quality Act39 of 2004 Minimum Emission Standards (MES) for its fleet of coal and fuel-fired power stations to the NAQO. i.e.,

Tutuka-, Majuba-, Camden-, Kriel-, Matla-, Kendal-, Duvha-, Arnot-, Hendrina-, Komati -, and Grootvlei power stations in the Mpumalanga Highveld Region and Lethabo Power Station in the Vaal Triangle.
Acacia-, Port Rex, Medupi and Matimba stations in the Cape Region and Lephalale.

In November 2021, the DFFE NAQO issued positive postponement decisions for Grootvlei, Arnot, Hendrina, Camden, Komati, Acacia, and Port Rex power stations. Eskom’s request for postponements at Matla, Duvha, Matimba, Medupi and Lethabo power stations were all refused in their entirety. Postponement applications for Majuba, Tutuka, Kendal, and Kriel stations were partially granted.

Eskom has lodged an appeal against these decisions to the NAQO in December 2021. The utility believes these decisions have a significant impact on its ability to provide electricity nationally, to the economy, and the country’s plan in terms of a just energy transition.

APPEAL AVAILABLE FOR INSPECTION AND COMMENT

The Minister for Forestry, Fisheries and the Environment has in 2022 established a National Environmental Advisory and Consultative forum to advise her in terms of the MES issue and the appeal process was suspended while the Forum process was underway. The work of the Forum is continuing but based on consultation with the DFFE and in line with Regulation 5 of the National Appeal Regulations of 2014, the appeal must now be made available for 20-days comment from 28 July until 17 August 2023.

Parties wishing to submit a responding statement on the grounds of appeal, must capture and submit it in writing in the prescribed ‘DFFE Appeal and Response Report’ form also obtainable from the Naledzi website. The statement must be submitted to the below specified appeal authority and Eskom within 20-days from the date of appeal notice, on or before 17 August 2023.
